With a Chapter 13, the debtor is looking to come up with an affordable monthly payment plan to be made over the span of a maximum of sixty (60) months to help repay back debts owed to their creditors. If the debtor makes all payments on time over the course of the Chapter 13 plan, then the debts will be discharged after all payments have been fulfilled over the course of the plan. Bankruptcy can also be utilized for protection to stop foreclosure on homes or the repossession of automobiles with what is known as an “automatic stay” which goes into effect after the bankruptcy petition is filed.
