2. What is a dismissal?

A case dismissal sometimes occurs in a Chapter 13. Cases are dismissed for failure to make Chapter 13 payments to the Bankruptcy trustee. Because case dismissal ends protection from the creditors, it is important to speak with an attorney about the possibility of reinstating the case or filing another case.

3. What is the credit-counseling certificate?

To file bankruptcy, you must receive credit counseling within the 180 days before filing from an approved credit-counseling agency. This briefing can be completed online, in person, or over the phone. The counseling takes approximately 60 minutes. We will give you a list of the approved credit counselors.

4. What is the personal financial management certificate?

You receive the personal financial management certificate after you complete a debtor education course. You must complete the course to obtain your bankruptcy discharge. Most of the counselors that conduct the pre-filing counseling also conduct the debtor education course. It can be completed on-line or over the phone. The course takes approximately 90 minutes.

5. Do you provide alternatives to bankruptcy or post-bankruptcy services?

Yes. We have a homebuyer assistance program and a credit repair program. These programs are helpful for debtors after filing bankruptcy. We also offer debt settlement and credit counseling programs as alternatives to filing bankruptcy.

6. What is a case reinstatement?

Once a case is dismissed for failure to pay the bankruptcy trustee, we can often file a motion to reinstate the case. The reinstatement is successful if you can immediately become current in your payments to the trustee. You must be aware that the bankruptcy protection against foreclosure and repossession is not reinstated until the court enters an Order reinstating your case.

7. What documents do I need for my free initial consultation?

No documents are necessary, although a recent pay stub may be helpful.

8. What documents do I need before my case can be filed?

The documents vary depending on your circumstances. We will give you a list at the consultation. In most cases, we only need 2 years of tax returns and six months of pay stubs.

9. What happens at the final appointment with Weller Legal Group?

At the final appointment before filing, we have your Bankruptcy paperwork prepared. You will sit down with one of our qualified Paralegals and make sure all of the documents are accurate. If you are filing a Chapter 13, we will give you your plan for repayment. We will give you directions and instructions for your 341 meeting of creditors.

10. What assets will I lose if I file bankruptcy?

In a Chapter 7, you can keep all “exempt” property. A Chapter 7 trustee will sell or liquidate any “non-exempt” property. Exempt property is property protected by law from your creditors. The new exemption laws are complicated. You should consult with one of our attorneys to determine which assets are exempt. In a Chapter 13, you can keep all of your property; however, your payment will increase to retain non-exempt assets.
