1. What is a confirmation hearing?

The confirmation hearing is a hearing for your Bankruptcy Judge to “confirm” or approve your bankruptcy plan. One of our attorneys will appear on your behalf. It is not required for you to attend the confirmation hearing.

2. What is a discharge?

The discharge permanently forgives you from all debts provided for in your case with limited exceptions (criminal restitution, some taxes, most student loans, alimony, child support, ongoing mortgage debt). This means that creditors cannot initiate or continue any lawsuits or other collection activity against you to collect on the discharged obligation.

3. Where will my case be filed?

From Bradenton Fort Myers Sarasota
Go 1 75 North Get on the Crosstown Expressway (toll road). Get off at the Kennedy Exit. Take a right on North Florida Ave. Go four blocks. The courthouse will be on the right. OR Exit 60 West. SR 60 turns into Kennedy Blvd. Turn right on North Florida Ave. Go four blocks. The courthouse will be on the right.

From Brooksville or Dade City
Go 1 75 South Take 1 275 South. Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Clearwater, Largo or Palm Harbor
'Take Highway 60 across Old Tampa Bay (Courtney Campbell Causeway). Follow Highway 60 East towards Tampa. Get on 1 275 North. Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Lakeland and Plant City
Go 1 4 West Get on 1 275 South and get off at Exit 44. Go south on Ashley Dr. At Cass St. go left for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Lutz and Temple Terrace
Go 1 275 South Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From St. Petersburg
Go 1 275 North Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

4. What is the “means test?”


It is a test applied if your 6-month pre-filing income is more than Florida’s median income for your family size. The test begins with your pre-filing income and deducts certain allowances and actual expenses. If the test indicates that you can repay a certain amount of your creditors, in most cases it is best to file a Chapter 13 bankruptcy. Most people considering Chapter 7 bankruptcy do not have trouble passing the means test.

5. Will I lose my home if I file bankruptcy?

Generally, the choice is yours to keep the home and continue with the ongoing mortgage payments or surrender the home and be released from further liability on the mortgage debt. In most cases, even a home with significant equity is protected from unsecured creditors in a bankruptcy. One of our attorneys can review your situation and discuss your options with you.

6. Will I lose my car if I file bankruptcy?

Generally, the choice is yours to keep the car and continue with the ongoing car payments or surrender the car and owe no money on the deficiency. If you have significant equity in the car it may be non-exempt and subject to liquidation in a Chapter 7 Bankruptcy. Equity is the amount the car is worth after deducting any loans on the vehicle. You may keep a vehicle with significant equity in a Chapter 13 Bankruptcy. A Chapter 13 Bankruptcy may also allow you to reduce your automobile interest rate, stretch out your payments, and/or reduce the principle balance owed.
